HC directs FSSAI to file report by Nov 28

The High Court of Bombay at Goa has directed the FSSAI to file its report positively by November 28 specifying the standards in relation to the sale of fish in the state of Goa in the context of the issue of presence of formalin.

The High Court observed that if for any reason such report is not being filed by the said date, then the executive officer of FSSAI to remain present in this Court personally along with all records to indicate the steps taken in the matter and the reasons for non-compliance.

It is necessary to note that there is a batch of public interest litigations on the issue and from time to time these matters are required to be adjourned only because of the FSSAI report.

By the order dated October 29, 2018, the High Court had directed the FSSAI to specify the standards in relation to the sale of fish in the state of Goa in the context of the issue of presence of formalin therein. Since the High Court was informed that this exercise would involve consultations with experts, the Court had deliberately granted sufficient time to FSSAI for this purpose.

The report was expected within six months or thereabout from the making of the High Court order. 

The High Court observed, “However, no such report is forthcoming. Finally, we noted in our order dated August 28, 2019 the statement made on behalf of the counsel appearing for FSSAI that the report will be filed within four weeks from the said date. This time period expired on September 28, 2019. However, neither is any extension applied for nor is any report filed. The counsel for the FSSAI is not even present in Court.”
