Rape accused ‘happily married’ to victim acquitted by children’s court

PANAJI: The children's court has acquitted a 24-year-old, accused of repeated rape of a 16-year-old girl in 2015 in North Goa.

During the cross examination the girl stated that she is happily married to the accused and produced a marriage certificate. She stated she has no complaint of any nature against the accused and does not intend to proceed with the case.

The order passed by president of the court Vandana Tendulkar stated that the forensic report was negative and there was no medical evidence to support the case of the prosecution. It also stated that there was no evidence of recent or remote sexual intercourse.

The court observed that the prosecution failed to link either the muddemal property or the accused with the sexual offences against him and added that during the entire investigation, the police was unable to secure the presence of the father of the victim girl who was the complainant.

The court stated that the testimony reveals the victim and the accused knew each other since 2013 and he proposed to her the same year. She told him to ask her elder brother, who consented. The two subsequently started meeting but the parents were not aware. When they found out they asked them to end the relationship.

Despite objection, the two continued to meet.

The parents took the girl to the police station and filed a complaint in September 2015, after she had spent the entire day at the accused's maternal uncle's house.

Public prosecutor S Nagvenkar argued on behalf of the state and M Carvalho on behalf of the accused. The prosecution examined two witnesses in support of the case. No evidence was led in defence by the accused.
